Terms of Service (End User License Agreement)

Welcome to MindfulFlow. MindfulFlow is owned and operated by Daniel Dolhý ("Developer," "MindfulFlow," "we," "our," or "us"), operating under the laws of the Slovak Republic and the European Union. By downloading, accessing, or using the MindfulFlow mobile application, web application at https://mindfulflow.app/, or related services (collectively, the "App"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use the App.

For downloads of the App from the Apple App Store, these Terms supplement and incorporate by reference Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between these Terms and the Apple Standard EULA regarding mandatory Apple App Store terms, the Apple Standard EULA shall govern.

1. Use of the App and Eligibility

MindfulFlow is an AI-powered daily productivity, routine, and task-planning tool designed to help users—including neurodivergent and ADHD users—organize their daily activities, voice brain dumps, routines, focus timers, and calendars.

• Eligibility: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, including 16 in applicable European Union Member States unless verifiable parental consent is provided) to create an account and use the App.
• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Acceptable Use: You agree not to use the App for any unlawful, harmful, abusive, or unauthorized purpose, and you agree not to reverse engineer, decompile, disassemble, scrape, probe, overload, or attempt to extract the source code, API keys, or underlying AI prompts/models of any part of the App.

2. Intellectual Property, User Content, and License

All rights, title, and interest in and to the App—including its software code, design, interface, logos, trademarks, and proprietary algorithms (excluding your User Content)—are and shall remain the exclusive property of Daniel Dolhý.

You retain full ownership of the tasks, voice notes, brain dumps, schedules, habits, calendar entries, and other content you input or create within MindfulFlow ("User Content"). By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free, revocable license to host, store, transmit, transcribe, and process your User Content (including via our third-party cloud infrastructure and opt-in AI providers described in our Privacy Policy) solely as necessary to provide, maintain, and improve the App's features for you. If you submit feedback, feature ideas, or bug reports, you grant us a royalty-free, perpetual license to use and incorporate that feedback without restriction or compensation.

3. Enhanced & Premium Features (Auto-Renewing Subscriptions & Lifetime Access)

MindfulFlow is free to download and offers optional paid plans ("MindfulFlow Premium") that unlock full access to AI schedule generation, unlimited voice brain dumps, routines, widgets, and calendar synchronization.

3.1 Available Plans

MindfulFlow currently offers the following Premium access options (exact prices may vary by country, currency, and local taxes as displayed on your store checkout screen prior to purchase):

• Monthly Subscription: $8.99 USD per month (auto-renewing monthly)
• Six-Month Subscription: $39.99 USD per 6 months (auto-renewing every 6 months)
• Annual (Yearly) Subscription: $49.99 USD per year (auto-renewing annually)
• Lifetime Access: $129.99 USD one-time purchase (non-recurring payment for the active commercial lifetime of the App)

3.2 Billing and Payment

All subscriptions and in-app purchases are billed and processed directly by the platform provider through which you downloaded or accessed the App (Apple App Store via In-App Purchase, Google Play Store, or our web checkout powered by RevenueCat/Stripe). For Apple App Store purchases, payment will be charged to your Apple ID account at confirmation of purchase.

3.3 Automatic Renewal & Price Changes

Auto-renewing subscriptions (Monthly, Six-Month, and Annual) automatically renew at the end of each billing cycle unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate. If we change the price of an auto-renewing subscription, you will be notified in advance by Apple, Google Play, or Stripe in accordance with platform rules and will have the opportunity to cancel before the new price takes effect.

3.4 Free Trials

We may offer a free trial period (such as a 7-day free trial) for eligible new subscribers. Unless you cancel your subscription in your platform Account Settings at least 24 hours before the end of the free trial period, your free trial will automatically convert into a paid auto-renewing subscription at the price and billing frequency shown when you started the trial. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to MindfulFlow Premium, where applicable.

3.5 Managing Subscriptions, Cancellations, Refunds, and EU Digital Content Notice

You can manage your subscription and turn off auto-renewal at any time after purchase by going to your Account Settings in the Apple App Store (Settings > [Your Name] > Subscriptions on iOS) or Google Play Store. Deleting the App or deleting your MindfulFlow user account does not automatically cancel an active Apple App Store or Google Play subscription—you must cancel the subscription in your device's store settings. Because Apple and Google process billing directly, we cannot issue refunds directly for App Store or Google Play purchases; please request refunds through Apple Support (https://reportaproblem.apple.com/) or Google Play Support in accordance with their refund policies. For European Union and UK consumers, statutory digital-content withdrawal rules and immediate-access waivers are administered through the checkout platform (Apple App Store, Google Play, or Stripe) at the time of purchase.

4. Google Calendar, Google Assistant & Voice Actions Integrations

If you choose to connect your Google Calendar or use voice integrations, assistant capabilities, or deep-linking services in MindfulFlow (including Google Calendar OAuth sync, Actions on Google, Google Assistant shortcuts, or "Hey Google" voice triggers), you agree to the following:

• Google APIs & Additional Terms: By accessing or using Google integrations, you agree to be bound by the Google Terms of Service (https://policies.google.com/terms), the Google APIs Terms of Service (https://developers.google.com/terms/), and the Actions on Google Additional Terms.
• Calendar Sync Authorization: When you explicitly connect Google Calendar, you authorize MindfulFlow to read your calendar events (to detect schedule conflicts and display your timeline) and write/update time-blocked tasks or events that you confirm inside the App. You may revoke Google Calendar access at any time in your MindfulFlow Profile Settings or at https://myaccount.google.com/permissions.
• Firebase Terms: Any use of Firebase authentication and cloud sync infrastructure is subject to applicable Google Firebase terms.
• Assistant License & Disclaimers: Where you use Actions on Google, you authorize Google and its affiliates to access, format, and process your voice command content to enable assistant integrations. Third-party integrations are provided "AS IS" and "AS AVAILABLE" without warranty.

5. Medical, AI Output & Productivity Disclaimer

MindfulFlow is a personal organization, time-blocking, and productivity application designed to support focus and daily planning. MindfulFlow is NOT a medical device, healthcare provider, clinical diagnostic tool, or substitute for professional medical advice, diagnosis, psychiatric care, or ADHD therapy. Never disregard professional medical advice or delay seeking medical treatment because of anything generated or suggested by the App.

AI Output Disclaimer: Certain features of the App utilize generative artificial intelligence (Google Gemini / Vertex AI) to transcribe voice inputs, estimate task durations, break down goals, and suggest daily schedules. AI outputs are probabilistic and may occasionally be inaccurate, incomplete, or inappropriate for your specific circumstances. AI-generated schedules, task estimates, and reminders are suggestions only, and you are solely responsible for reviewing and verifying your schedule and obligations. Neither Daniel Dolhý nor MindfulFlow is responsible for missed appointments, missed deadlines, lost tasks, alarm/notification delivery failures, calendar conflicts, or any consequences resulting from reliance on the App.

6. Analytics, Service Availability & Modifications

By using MindfulFlow, you acknowledge that we collect diagnostic and usage event data (such as screen views, feature interactions, and crash logs) as detailed in our Privacy Policy to maintain stability and improve the App's user experience. We reserve the right to modify, update, suspend, or discontinue any feature or part of the App at any time, and we shall not be liable for any downtime, service interruption, or outage caused by third-party cloud providers, AI APIs, or events beyond our reasonable control (force majeure).

7. Apple App Store Mandatory Terms (Guideline 3.1.2 & Apple Standard EULA)

If you downloaded the App from the Apple App Store, you and the Developer acknowledge and agree that:

• Scope of License: Your license to use the App is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: Daniel Dolhý, and not Apple Inc. ("Apple"), is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Product Claims & Intellectual Property: Daniel Dolhý, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, any claim arising under consumer protection or privacy legislation, and any third-party intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. FOR APPLE APP STORE USERS, IN THE EVENT OF ANY FAILURE OF THE APP TO CONFORM TO ANY APPLICABLE WARRANTY, YOU MAY NOTIFY APPLE, AND APPLE WILL REFUND THE PURCHASE PRICE (IF ANY) FOR THE APP TO YOU; TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE WILL HAVE NO OTHER WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO THE APP.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DANIEL DOLHÝ OR MINDFULFLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50.00 USD). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER MANDATORY CONSUMER LAW.

10. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Daniel Dolhý, MindfulFlow, and our service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the App, or your violation of any law or the rights of any third party.

11. Account Termination and Deletion

You may stop using the App and delete your account and all associated personal data at any time directly inside the App (Profile / Settings > Delete Account) or by contacting us at mindfulflowhelp@gmail.com. We reserve the right to suspend or terminate access to the App if you materially breach these Terms.

12. Governing Law, Dispute Resolution, and General Provisions

These Terms are governed by and construed in accordance with the laws of the Slovak Republic and applicable laws of the European Union, without regard to conflict-of-law principles. If you are a consumer residing in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, you also enjoy the protection of the mandatory provisions of the law of your country of residence.

Severability, No Waiver & Assignment: If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign these Terms without our prior written consent; Daniel Dolhý may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all assets related to the App. These Terms (together with the Privacy Policy and, where applicable, the Apple Standard EULA) constitute the entire agreement between you and Daniel Dolhý regarding the App.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and post the revised Terms at https://mindfulflow.app/terms-and-privacy.html#terms. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

MindfulFlow ("MindfulFlow," "we," "our," or "us") is owned and operated by Daniel Dolhý ("Data Controller," located in the Slovak Republic, European Union). We are committed to protecting your privacy and handling your personal data transparently in compliance with the European Union General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), the Google API Services User Data Policy, and Apple App Store Review Guidelines (including Guideline 5.1.1).

This Privacy Policy explains what information we collect, why we collect it, how we use and share it, how long we retain it, and how you can exercise your privacy rights (including 1-tap in-app account and data deletion) when you use the MindfulFlow iOS, Android, and Web applications at https://mindfulflow.app/ (collectively, the "App").

2. Information We Collect

2.1 Information You Provide Directly

• Account & Authentication Data: When you create an account or sign in (via Email/Password, Sign in with Apple, or Google Sign-In powered by Firebase Authentication), we collect your email address, display name (if provided), and an internal authentication User ID. You may also use Guest Mode without creating an account.
• User Content & Productivity Data: Tasks, to-do lists, voice brain-dump transcripts, notes, daily schedules, time blocks, routine checklists, mood/energy check-in selections, and habit records that you voluntarily create in the App.
• Support Communications: Any information you provide when contacting us at mindfulflowhelp@gmail.com.

2.2 Information Collected With Your Explicit Permission (Device & Account Permissions)

• Microphone & Voice Audio Data: When you tap the microphone button to use Voice Brain Dump or voice task capture, the App requests access to your device's microphone. Your voice audio is transmitted securely to transcribe your speech into structured tasks and time blocks. We do not store raw audio recordings permanently on our servers once transcription and task extraction are complete. You can revoke microphone access at any time in your iOS/Android device settings.
• Google Calendar Data (Optional OAuth Integration): If you explicitly choose to connect your Google Calendar, we request access to view and manage your calendar events solely so MindfulFlow can (a) display your existing calendar appointments alongside your daily tasks, (b) avoid scheduling AI time blocks over busy calendar slots, and (c) write or update time-blocked tasks to your Google Calendar when you confirm them. We do not access Google Calendar data unless you initiate the connection.

2.3 Information Collected Automatically

• Usage Data & Product Interaction (Analytics): We use Google Analytics for Firebase to collect pseudonymized interaction events (such as screen views, feature usage like AI schedule generation or timer completion, and session duration) to understand app performance and improve user experience.
• Device & Diagnostic Information: Device model, operating system version, language/locale, app version, and crash/error diagnostics to fix bugs and maintain stability.
• Subscription & Purchase History: When you subscribe to MindfulFlow Premium ($8.99/month, $39.99/6 months, $49.99/year, or $129.99 Lifetime), RevenueCat processes an anonymous App User ID, product identifier, and subscription receipt/entitlement status. We never collect, see, or store your credit card number, bank account, or billing details—all payment details are handled directly by Apple (In-App Purchase), Google Play, or Stripe.
• Local Storage & Essential Session Tokens: On our web application and mobile app, we use local storage (localStorage / IndexedDB) and essential Firebase authentication tokens solely to keep you signed in, store your UI preferences (such as theme and onboarding state), and support offline task caching. We do not use third-party advertising cookies or cross-site tracking pixels.

3. How We Use Your Information & GDPR Legal Bases

We use the information we collect only for the following specific purposes and under the following GDPR legal bases (Article 6(1) GDPR):

• Providing Core App Functionality (Art. 6(1)(b) – Performance of a Contract): Syncing your tasks, routines, and schedules across devices; authenticating your account; and managing your Premium subscription entitlements.
• AI Schedule Generation & Voice Brain Dump Processing (Art. 6(1)(a) & (b) – Explicit User Initiation / Consent & Contract): Converting your voice brain dumps and task lists into realistic, time-blocked daily schedules when you trigger AI planning features.
• Google Calendar Synchronization (Art. 6(1)(a) – Explicit Consent): Reading your calendar availability and writing confirmed time blocks to your Google Calendar at your direction.
• App Analytics, Stability & Security (Art. 6(1)(f) – Legitimate Interests): Diagnosing crashes, preventing abuse, and improving App usability.
• Customer Support & Legal Compliance (Art. 6(1)(b) & (c)): Responding to your support requests and complying with applicable tax, accounting, and legal obligations.

We do not sell your personal data to third parties, we do not use your personal data for third-party cross-app behavioral advertising or data brokering, and we do not engage in automated decision-making or profiling that produces legal or similarly significant effects on you (Article 22 GDPR).

4. Third-Party Service Providers & AI Processing Disclosure

We share data only with trusted service providers ("Data Processors") strictly necessary to operate the App, each bound by contractual data-protection obligations providing equal or equivalent protection of your personal data:

• Google Firebase (Google Ireland Limited / Google LLC): Provides user authentication (Firebase Auth), cloud database storage (Cloud Firestore), cloud functions, hosting, and app usage analytics (Google Analytics for Firebase). Privacy Policy: https://policies.google.com/privacy
• Google Gemini AI & Google Cloud Vertex AI: Powers MindfulFlow's smart scheduling density, task sequencing, and voice brain-dump transcription. When you explicitly initiate AI features (and after providing in-app AI consent), MindfulFlow transmits your current task list, selected mood/energy context, voice audio/text input, and local date/time context over encrypted HTTPS to Google Gemini AI / Vertex AI. Under our API configuration and Google's paid API terms, your data is processed solely to return your scheduled output, is not retained permanently by the AI model, and is not used to train Google's foundation models.
• Google Calendar API & Google Assistant / Actions on Google: Used only when you explicitly connect Google Calendar or invoke voice shortcuts. Processed in accordance with Google's Privacy Policy.
• RevenueCat, Inc.: Manages subscription validation and cross-platform Premium entitlements using anonymous or pseudonymous App User IDs. Privacy Policy: https://www.revenuecat.com/privacy/
• Apple Inc., Google LLC & Stripe, Inc.: Process App Store, Google Play, and web checkout payments and subscription management.

5. Google API Services User Data Policy ("Limited Use" Disclosure)

MindfulFlow's use and transfer to any other app of information received from Google APIs (including Google Calendar API and Google Sign-In) adheres strictly to the Google API Services User Data Policy, including the Limited Use requirements:

• We only use Google Calendar data to display your schedule and sync time-blocked tasks at your explicit request inside the App.
• We never transfer Google user data to third parties except as necessary to provide or improve user-facing App features with your explicit consent, for security/legal compliance, or in connection with a merger/acquisition after notice.
• We never use or transfer Google user data for serving advertisements, retargeting, or creditworthiness determination.
• Humans do not read your Google Calendar or task data unless we have your affirmative agreement for a specific support issue, or it is strictly necessary for security/abuse investigation or legal compliance.

6. Apple App Store Privacy Nutrition Label Summary

To ensure 100% transparency with our Apple App Store Privacy Notice:

• Contact Info (Name, Email Address): Collected for App Functionality and Account Authentication.
• Identifiers (User ID): Collected for App Functionality and Subscription Management via Firebase Auth and RevenueCat.
• User Content (Audio Data, Customer Support, Other User Content — Tasks, Notes, Schedule Entries): Collected for App Functionality only when you input tasks, use voice capture, or contact support. Raw voice audio is processed transiently for transcription and is not stored permanently.
• Purchases (Purchase History / Subscription Status): Collected via RevenueCat for App Functionality.
• Usage Data (Product Interaction): Collected for App Functionality and Analytics to improve usability.
• Diagnostics (Crash Data, Performance Data): Collected for App Functionality to maintain stability.
• Tracking: MindfulFlow does not track you across third-party apps or websites for advertising purposes (zero IDFA / zero third-party ad tracking).

7. Data Retention & How to Delete Your Account and Data (Apple Guideline 5.1.1(v))

We retain your personal data only for as long as your account remains active or as needed to provide the App's services to you.

• In-App Self-Service Account Deletion: You can permanently delete your MindfulFlow account and all associated personal data (including your profile, saved tasks, routines, schedules, and cloud-synced records) at any time directly inside the App by opening Profile / Settings and selecting "Delete Account" (and confirming deletion). Upon confirmation, your account credentials and cloud-stored User Content are permanently deleted from our active Firebase databases immediately (and purged from encrypted backups within 30 days).
• Web / Email Deletion Request: If you have uninstalled the App or prefer to request deletion outside the App, email mindfulflowhelp@gmail.com from the email address associated with your account with the subject line "Delete My MindfulFlow Account," and we will permanently delete all associated personal data within 7 business days (and in all cases within 30 days).
• Revoking Third-Party Connections: You can disconnect Google Calendar or Sign in with Apple at any time in your App settings, at https://myaccount.google.com/permissions, or in iOS Settings > [Your Name] > Sign-In & Security > Sign in with Apple.

8. International Data Transfers & Security

Your information may be processed and stored on secure cloud servers operated by Google Cloud / Firebase and RevenueCat in the European Union and the United States. Where personal data is transferred outside the European Economic Area (EEA) or United Kingdom, we rely on the EU-U.S. Data Privacy Framework and/or European Commission Standard Contractual Clauses (SCCs) to safeguard your data. All data in transit between the App and our servers is encrypted using industry-standard TLS/HTTPS, and access to production databases is restricted by strict Firebase Security Rules. In the unlikely event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority and affected users in accordance with Articles 33 and 34 of the GDPR.

9. Your Privacy Rights (GDPR, UK GDPR & CCPA/CPRA)

Depending on where you live, you have the right to:

• Access and receive a portable copy of the personal data we hold about you;
• Correct inaccurate or incomplete personal data;
• Delete your account and erase your personal data ("Right to be Forgotten");
• Restrict or object to certain processing of your personal data;
• Withdraw your consent at any time where processing is based on consent (such as microphone access, AI scheduling, or Google Calendar sync);
• Lodge a complaint with your local data protection supervisory authority (in the Slovak Republic, the Office for Personal Data Protection / Úrad na ochranu osobných údajov Slovenskej republiky, https://dataprotection.gov.sk/).

California residents also have the right to know what personal information is collected, to request deletion, and to be free from discrimination for exercising privacy rights. We do not "sell" or "share" personal information as defined by the CCPA/CPRA. To exercise any of these rights, use the in-app "Delete Account" button or email us at mindfulflowhelp@gmail.com.

10. Children's Privacy

MindfulFlow is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal data from a child under 13 without verifiable parental consent, we will promptly delete that data. If you believe a child under 13 has provided data to us, please contact mindfulflowhelp@gmail.com.

11. Changes to This Privacy Policy
